Who and What
Formcrafts is an online form builder, run and managed by Subtle Web Inc. It allows Creators to build forms and collect data from Respondents.
What Information Does Formcrafts Collect?
Form Creators
We explicitly ask for an email address, which is compulsory to create an account with Formcrafts. Creators can optionally provide us with name and organization, which is used on invoices, and other tasks relating to usage of Formcrafts. Formcrafts also collects information relating to country and region, requested language, requested web resource, and features used in the account.
Form Respondents
Aside from the form data filled in by respondents, we use geolocation data to better help our Creators understand their Respondents. The geolocation data is limited to Respondent's region, and does not include any personally identifiable information. We also collect information relating to requested language, requested web resource, and time spent.
Does Formcrafts share my information?
Formcrafts does not share or sell any information it collects with third-parties.
One exception to the rule is that Formcrafts shares information with legal authorities, where required by law. This usually happens when Formcrafts is being used for illegal purposes.
Usage
By accessing this web site, you are agreeing to be bound by these web site Terms and Conditions of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. The materials contained in this web site are protected by applicable copyright and trade mark law.
Subscription and Fee
Formcrafts offers paid, as well as free plans. The free plans may have an expiry, and a paid plan will have to be purchased for continuous use. Paid plans are available on monthly / yearly subscriptions. Formcrafts may change its plans, feature-set, and pricing structure at any time - with prior notice for paid plans, and without prior notice for free plans.
A 100% refund can be provided within 10 days of last bill for monthly plans. For annual plans, 75% refund can be provided within 30 days of refund request, and no refund thereafter.
Membership
You are responsible for safeguarding the confidentiality of your account. You agree to notify Formcrafts of any unauthorized use of your account or any other breach of security, not limited to your account, known to you. By becoming a member, you agree to let Formcrafts use your organization's logo in its customer list, and at other places on its website.
Brand Links
We insert a 'powered by' link and 'report abuse' link on forms associated with unpaid accounts. We may add the Formcrafts branding on other places like the success message. Removing, hiding, or altering the form in a way so as to hide the link can result in suspension of the account.
PCI Compliance
Formcrafts does not store payment data. We use a third party service called Stripe to handle payments. Stripe has been audited by an independent PCI Qualified Security Assessor (QSA) and is certified as a PCI Level 1 Service Provider.
Employee Data Access
Employee access to Formcrafts' servers and datastore is highly restricted, and based on the concept of least privilege. Employee access is routinely monitored and the access is revoked when the person leaves the organization.
Data Storage Policies
Your data is stored on our servers with Digital Ocean, hosted primarily in New York. Digital Ocean is AICPA SOC 2 Type II certified cloud provider. Your data is encrypted in transit and at rest. We take daily backups.
Data Retention
We reserve the right to delete inactive accounts. We also reserve the right to delete data older than 3 years for current customers.
Cookie Policy
Form Creators
Formcrafts uses cookies for authentication, and to remember your login preferences. Formcrafts does not use ad-tracking cookies, and hence does not require your consent for using cookies.
Form Respondents
Formcrafts uses session storage to remember certain information like partial response data, form progress, repeat form submissions, etc. This is done to provide a better user experience. This data is not sent to Formcrafts servers.
Use of Data for AI Training
We leverage anonymized non-personal data to enhance our services through AI and machine learning. This helps us innovate and improve our platform's functionalities. This data includes form name, form fields, form configuration, styling, field labels, and other non-personal data.
We strictly exclude all personal data, including form responses and customer information, from AI training. Our priority is to protect your privacy and ensure the security of your data.
If you prefer not to have your data included in AI training, you have the freedom to opt out. Simply contact us at [email protected], and we will exclude data associated with your account from AI training activities.
Disclaimer
The services of Formcrafts are provided 'as is'. Formcrafts hereby disclaims all warranties of any kind, expressed or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose, and non-infringement. Neither Formcrafts, nor its contractors, makes any warranty that the Client, Service, or website will be error free, free of viruses or other harmful components, or that access thereto will be continuous or uninterrupted. You agree to use Formcrafts at your own discretion and risk.
Formcrafts will not be liable to you or any third-party for any direct, indirect, special, punitive, consequential (including, without limitation, lost profits or lost data collected through the service and/or use of the the Formcrafts), or incidental damages, whether based on a claim, or action of contract, warranty, negligence, strict liability, tort, breach of any statutory duty, or otherwise.
Formcrafts does not guarantee the Service will be operable at all times or during any down time, including, but not limited to, Internet Service Provider outages, equipment failures, or scheduled maintenance.
Formcrafts provides integrations with third-party services which allows you to use our forms to accept payments from your site visitors. FormCraft is not responsible for any charge-backs, disputes, frauds, or loss resulting from using this feature. If there are any disputed payments, you should talk to your payment processor.
Please do not accept credit card information from your forms, unless you are using our payment add-ons. Formcrafts is not liable for any consequential damage, theft of data, or loss caused.
Accepting Payments
Formcrafts provides integrations with third-party services which allows you to use our forms to accept payments. We do not hold any credit card / debit card information on our servers. Formcrafts is not responsible for any charge-backs, disputes, frauds, or loss resulting from using this feature. If there any disputed payments, you should talk to your payment service provider.
Content
The materials appearing on Formcrafts' website could include technical, typographical, or photographic errors. Formcrafts does not warrant that any of the materials on its website are accurate, complete, or current. Formcrafts may make changes to the materials contained on its website at any time without notice. Formcrafts does not, however, make any commitment to update the materials. Formcrafts has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Formcrafts of the site. Use of any such website is at the user's own risk.
Modification of Terms
Formcrafts may revise these terms of use for its web site at any time without notice. By using this web site you are agreeing to be bound by the then current version of these Terms of Service.
Other
If you are using the Google Spreadsheet add-on we provide, we would use the app permissions to create spreadsheet file(s) and modify the connected spreadsheet(s) to add new rows based on incoming submissions. We do not access any other data.
